Notice to Parents of Students with Disabilities

NOTICE TO PARENTS OF STUDENTS WITH DISABILITIES

 

            Student files maintained by the East Central Kansas Special Education Cooperative are considered to be confidential.  Safeguards and procedures to govern access of pupil records to all parties have been established within the schools and the cooperative office.  These procedures are consistent with the intent of the Family Rights and Privacy Act of 1974 (FERPA) a.k.a. Buckley Amendment as amended and the Individuals with Disabilities Education Act (IDEA).  Special education files are maintained at the cooperative office by the director of the cooperative and in each of the schools of participating districts by building principals.  A list of the types and locations of education records collected, used and maintained by the cooperative as well as the officials responsible is available to parents or eligible students upon request.

            Records shall be released without prior consent only in the following instances:  1) to other school officials within the agency who have been determined to have legitimate educational interests;  

2) to officials of another school or institution of post secondary education where the student seeks to enroll;  

3) to authorized representatives of the Comptroller General of the United States, the Secretary of State and local educational authorities as subject to requirements of Reg. 99.35 and  

4) in certain instances in connection with financial aid for which the student has applied as stipulated under Public Law 93-380.

                Under regulations of IDEA parents or eligible students have the right to:

a) inspect and review the student's records;

b) request an admendment of the student's education records;

c) refuse to consent to disclosure of personally identifiable information, except to the extent that federal laws authorize disclosure without consent;

d) file a complaint with the Kansas State Board of Education or the U.S, Department of Education concerning alleged failures to comply with state and federal confidentiality policies and procedures.
